PARTIAL LIST OF CHILD VICTIMS OF SREBRENICA GENOCIDE

January 25, 2008 31 comments

IN MEMORIAM to the KILLED CHILDREN OF SREBRENICA GENOCIDE
We will never forget you, as you will always remain in our hearts.

PARTIAL LIST OF AT LEAST 500 CHILDREN WHO WERE SUMMARILY EXECUTED DURING SREBRENICA GENOCIDE & DUMPED INTO MASS GRAVES

The United Nations Convention on the Rights of the Child defines a child as “every human being below the age of 18 years unless under the law applicable to the child, majority is attained earlier.”

The following is a list of approximately 500 children, victims of Srebrenica genocide, who were under the age of 18 on July 11 1995. Some children were shot in the head.

Over 8,000 Bosniak Muslims were summarily executed by the Bosnian Serb Army during Srebrenica genocide in July 1995.

They were dumped into mass graves and Drina river and many bodies will likely never be recovered. Click here to learn more about Srebrenica Genocide.

Please note that this is only a preliminary list of child victims and is considered a minimum (OR partial) number of victims.

Additional 297 victims, for example, listed on the Federal Commission’s list (not included in this breakdown) are age-unidentified and there is more victims who have not even been included in the list.

The Federal Commission’s list contains a list of at least 8,106 Srebrenica genocide victims in order of First/Last Name, Father’s Name, JMBG ID#, and DOB.

FBI INVESTIGATING DARKO TRIFUNOVIC

January 18, 2008 2 comments

Bosnjaci.net is the voice of a multi-ethnic, multi-religious group of Muslim, Christian and Jewish reporters, academics, NGOs and current/former political officials.

Update (14:06pm): Contrary to Darko Trifunovic’s claims published at “Serbian Unity Congress” website in which he alleges that information against him was “fabricated,” the fact of the matter is that he was the author of an E-mail in which he stated: “I wish Mladic killed them all.” We got in touch with contributing authors Haris Djapic and Alan Jusufovic and asked them to provide “Full Header” copy of Darko Trifunovic’s E-mail. Then we compared IP# of that E-mail with IP# of several other E-mails in which Darko Trifunovic threatened to the New York based magazine. The IP# was the same. Due to confidentiality reasons, we will not release IP#; however, we have forwarded this information to Bosnjaci.net and requested inclusion of this information into FBI investigation of recent threatening E-mails coming from Darko Trifunovic (his E-mail is publicly listed at the Serbian Unity Congress web site).

The attacks on the freedom of the press have been instigated by the Serbian based Srebrenica genocide denier and self-proclaimed “terrorism expert”, Darko Trifunovic, who has sent numerous threatening Emails to the multi-ethnic New York based Bosnjaci.net magazine uttering threats to the journalists (Bosniaks, Serbs, Croats, and Montenegrins) who criticized him. He has threatened them on several occassions that he would orchestrate the Denial of Service attacks, unless they stop criticising him. The FBI (Federal Bureau of Investigation) has opened a file on Darko Trifunovic’s and they are investigating threats the matter. The threteaning messages came from Darko Trifunovic’s Email which is publicly available on Serbian Unity Congress‘ web site. As a result of new events, the Euro Police Congress has removed message from their website which previously stated that Darko Trifunovic has withdrawn from Euro Police Congress due to alleged “fear of violence” from “radical groups.” We thank them for realizing who Darko Trifunovic really is and who they have been dealing with all this time.

The New York based Bosniaks magazine – which is temporarily offline as a result of Serbian DoS (Denial of Service) attacks on their server – asked us to publish this press release.

European Police Congress,
Organizers:

Dear Sirs,

As publisher of and contributors to Bosnjaci.net, we were confident that our communications to you were consistent with legality and the very mission of the European Police Congress. Mr. Darko Trifunovic has engaged in actions, actual crimes that the Congress and its participants should resolutely confront including:

1. Identity and document fraud after having falsely secured Bosnian-Herzegovinian citizenship and diplomatic status, (of which was then subsequently stripped by BiH authorities).
2. Inciting hatred and promoting hate crimes based on ethnic and religious identity.
3. Promoting the denial of genocide, so adjudicated by the ICTY and ICJ, and with the dangerous agenda for inciting and legitimizing current and potential ultra-national politics within Serbia, Montenegro and Bosnia & Herzegovina, (Republika Srpska) and new “grave violations of international humanitarian law.”
4. Now, incited/emboldened criminal/terror “hacker attack” on free media and our shared values of independent media/free speech.

Appropriately, somewhere within the Organization and participants of the European Police Congress and the German authorities, it was seen appropriate to no longer welcome Darko Trifunovic. We thank those who apparently supported this principled and legally founded action.

Unfortunate Legitimization of Hate Ideology and Lies

Unfortunately though, the message sent by (some) Organizers of the European Police Congress, in particular its website, was inconsistent. The message on the European Police Congress website legitimized the message that Darko Trifunovic was a “victim” of threats from Islamic extremists:

“Prof. Dr. Darko Trifunovic, University of Belgrade, Faculty of Security Studies, informed us that he will not be able to come to Berlin and to speak at the 11th European Police Congress, since he has been put under pressure by radical groups. He received very dangerous death threats. For this reason he decided not to expose himself and endanger the Congress.” (European Police Congress website, Panel II note).

The message on this Congress website is not true, and worse is legitimizing Darko Trifunovic’s genocide negation and hate ideology. It has fueled an unlawful, terrorist attack on Bosnjaci.net and spurred hate campaign urging new murder, ethnic cleansing and genocide directed at Bosniaks.

Srebrenica Genocide is Judicial Conclusion Deserving Notice by Political and Law Enforcement Authority: This is not Optional

First, as to the message on the European Police Congress website: Is Darko Trifunovic and his agenda actually still welcome to your Congress? You cannot be passive on this matter and convey to your participants and audience that the Congress still would welcome Trifunovic in spite of his personal criminal conduct, incitement, and negation of genocide. Particularly, the matter of negating genocide in Srebrenica is not a “local Balkan dispute.” The International Court of Justice and the ICTY have judged that Srebrenica was a victim of genocide, while under the presumed protection of NATO and the United Nations. It is not your option, as an organization bringing together law enforcement agencies from the Euro-Atlantic democracies, to discount as a “local Balkan consideration,” the genocide in Srebrenica or other grave violations of international humanitarian law in Bosnia & Herzegovina. You are obliged to act in a manner consistent with such judgments from the highest judicial authorities. As denying the Holocaust is criminalized/subject to sanction in most of the democratic world, and appropriately so, the denial of genocide in Srebrenica and Bosnia & Herzegovina must meet with like response.

President Ahmedinidjad’s minimization of the Holocaust and Trifunovic’s negation of genocide are equally offensive, and to us all who promote international humanitarian law and the rule of law.

Trifunovic Abuses European Congress website to further Lies

Second, Trifunovic is lying when he asserts that he has been “put under pressure by radical groups.” He has clearly labeled Bosnjaci.net as such “Islamic extremist group” and “Al-Qaeda affiliated.” (Trifunovic on “Terror Financing Blog.”)

Bosnjaci.net is the voice of a multi-ethnic, multi-religious group of Muslim, Christian and Jewish reporters, academics, NGOs and current/former political officials. We not only have no relationship to Al-Qaeda or Islamic extremism but promote shared values of a democratic, pluralistic and open society. We certainly would not condone any death threats against any person. Our efforts are sufficiently founded on legality and our shared principles.

Why did not Any Representative from the European Police Congress Verify, even Contact to Confirm Veracity of Trifunovic’s Allegations?

However, when the European Police Congress has given a platform, in particular this time on the website, to Mr. Trifunovic’s slanderous allegations, you have allowed this Congress to be exploited for a libelous campaign based upon complete untruths and lies. Did not anyone of you bother to check the evidence or just contact us to verify any truth to Trifunovic’s spin?

Criminal/Terror Attack on Free Speech Emboldened

Now, Bosnjaci.net has been subjected to a “hacker attack” initiated by ultranationalist haters and supporters of Trifunovic, and with threats emanating from areas and email addresses suspiciously akin to Trifunovic’s own. We await further evidence of Trifunovic’s direct criminal conspiracy in this attack on media institutions and free speech, and have contacted the FBI and other law enforcement agencies. However, undoubtedly Trifunovic’s threats and the legitimization of his message on the official website of the European Police Congress have emboldened this criminal terror attack upon free speech and Bosnjaci.net.

We respectfully request that the European Police Congress:
1. Investigate internally how the official website of the European Police Congress was misused for Trifunovic’s lies and has emboldened directly or otherwise a criminal/terror attack?
2. Has Trifunovic been “dis-invited” from the European Police Congress or is he still a welcome participant?
3. Measures that the Organizers of the European Police Congress would propose to counter the damage to people and free media resulting from this unfortunate event?

DUTCH DEMAND SERBIA TO DELIVER TOP WAR CRIMINALS

January 16, 2008 2 comments
NETHERLANDS WILL BLOCK SERBIAN EU PROGRESS UNTIL SREBRENICA GENOCIDE FUGITIVES CAUGHT

“If Serbia really wants a European future, they must also cooperate with the handing over of one of the persons responsible for the only genocide in the European continent after the second World War” – Maxime Verhagen, Foreign Minister of Netherlands

The Netherlands will not sign off on a deal paving the way for Serbia to join the European Union until Belgrade turns over war crimes fugitive Gen. Ratko Mladic, the Dutch foreign minister said Wednesday.

Maxime Verhagen (photo on the left) was meeting with his Slovenian counterpart Dimitrij Rupel of Slovenia, which holds the rotating EU presidency

Rupel wants Serbia to sign the preliminary pact later this month, but the Netherlands opposes the move, saying Belgrade can only take the next step toward full EU membership after it has arrested Mladic and handed him to the U.N.’s Yugoslav war crimes tribunal in The Hague.

“If Serbia really wants a European future, they must also cooperate with the handing over of one of the persons responsible for the only genocide in the European continent after the second World War,” Verhagen told reporters in a hotel on the outskirts of The Hague.

He was referring to Ratko Mladic’s military oversight of the 1995 Srebrenica massacre of more than 8,000 Bosniaks at Srebrenica, Bosnia, which the International Criminal Tribunal ruled was a genocide.

The admission of new EU members must be unanimous, giving the Netherlands the power to block Serbia’s advancement. Belgium has supported the Dutch position.

Earlier Wednesday, Rupel visited the war crimes tribunal, where new chief prosecutor Serge Brammertz told him the court’s view on Serbian cooperation was the same as Verhagen’s.

The EU commissioner in charge of the bloc’s expansion, Olli Rehn, has also said that the signing of the preliminary deal – called a Stabilization and Association Agreement – depends on whether Serbia fully cooperates with the U.N. war crimes court.

At issue has been whether Serbia’s assertion it is doing all it can to track down and arrest Mladic and the other fugitives would be seen as full cooperation.

Verhagen said that, as things stand, it would not be.

“My signature is linked to the full cooperation with the tribunal in The Hague and the best proof that there is full cooperation is that they deliver Mladic to The Hague,” he said.

But “we don’t ask the impossible … from Serbia,” he said. “We don’t ask them to deliver what they can’t deliver.

Ratko Mladic and former Bosnian Serb leader Radovan Karadzic are the top two of four suspects sought by the tribunal. War crimes prosecutors have lost track of Karadzic, who is the top political leader charged with genocide at Srebrenica, but they are sure Mladic remains in Serbia.

Serbia has said repeatedly it is doing all it can to arrest the fugitives and is working with tribunal investigators to track them down.

Brammertz, who replaced Carla Del Ponte at the start of January, issued a statement Wednesday saying that having the remaining fugitives arrested “remains an absolute priority.”

DARKO TRIFUNOVIC: FEAR, PREJUDICE, & SREBRENICA GENOCIDE DENIAL

January 14, 2008 2 comments
The following is an extended list of signatures by fellow Serbs, Croats, Montenegrins, and Bosniaks urging Euro Police Congress not to give any credence to Mr Darko Trifunovic’s latest claims circulating in radical Serbian media outlets and propagandist websites (e.g. Serbianna). We thank Bosnian newspapers for mentioning our Blog and bringing awareness against Srebrenica Genocide denial, which is the most dangerous obstacle for Bosniak/Serb relations and lasting peace (special thank you goes to Dnevni Avaz). Srebrenica Genocide Blog is a pro-victim blog, and will remain to be s0. As you can notice from our writings, we are not interested in being “even handed” with convicted criminals and genocide deniers; we condemn them and will continue to do so.

You are looking at a photo of Darko Trifunovic, Srebrenica genocide denier, who was also involved in “identity fraud” and document forgery during his time in B&H Foreign Ministry (and he got fired). He is possibly forging documents to defend Serbian war criminals standing trial at the Hague by providing his “expert” testimonies. In 2001, he stated for B92 that he had evidence of Radovan Karadzic’s military orders which could ultimately clear Karadzic of genocide charges. Considering Trifunovic’s document forgery background, we would not be surprised had he also worked on forging Radovan Karadzic’s military orders so they look as if Karadzic obeyed Geneva Convention. ICTY should be very careful when presented with this kind of tainted evidence and “expert” testimonies, because there is more than likely possibility that Karadzic’s camp has been involved in forging military orders to defend Karadzic from charges of genocide. Apart from evidence forgery, similar self-proclaimed “terrorism experts” were responsible for spreading flawed “intelligence” information to the CIA about non-existent Iraqi “weapons of mass destructions” and the alleged ties of deposed Iraqi leader Saddam Hussein with Al Qaeda, which led to bloody war and thousands of dead civilians. These kinds of people are selling what so many in the west are prepared to buy: fear, prejudice, and Srebrenica genocide denial.

At the end of this page, you will also find our short response to Mr Trifunovic concerning his claims that there was no decision on genocide in Srebrenica. Please feel free to add your name and post this letter to other websites, blogs, or/and sign it and send it to relevant human rights organization and media:

To: European Police Congress Organizers

Dear Sirs:

We would ask you to confirm that Darko Trifunovic will not be welcome to participate in this 11th European Police Congress. Further, we ask for you to confirm that his agenda of hate, revisionism and denial of genocide will be excluded from the current and future European Police Congress.

The statement on your website that Mr. Trifunovic has withdrawn due to threats to his person is unacceptable in that such still implies that his hateful agenda and genocide denial might be welcome in the future at your Congress. His hollow claim of “fear of violence” could also gain credence from posting on your website. We have and will not instigate or support any violence directed at any person, nor should you allow Mr. Trifunovic to use your website to give credibility to his slanderous claims that the campaign directed at his teachings and promotion is promulgated by “White Al-Qaeda.” You should note that many who have written and urged that Darko Trifunovic and his agenda be banned, in fact are not even “Muslims.” They include Croat Catholics, Montenegran Orthodox, Dutch lawyers, Jewish writers, American business persons and others including Serbs. Any claim that Trifunovic is confronted by Islamic extremists is flawed from the outset. He is an offense to all. Our efforts are democratic, certainly peaceful and consistent with the evidence, justice and the rule of law.

“Identity fraud” or, more specifically, procuring Bosnian & Herzegovinian documents is also on Mr. Darko Trifunovic’s resume. He had procured Bosnian/Herzegovinian travel documents and traveled through many European states with such until his fraud was uncovered and the BiH authorities took away his passport.

The crimes that Mr. Trifunovic, and others, deny and/or rationalize have been so ruled by international and national judicial authorities, including the International Criminal Tribunal for the former Yugoslavia and the International Court of Justice. Prosecution of offenders has been executed in international and national criminal proceedings. It is not optional whether you or we accept the evidence and fact of such genocide in Srebrenica or other grave violations of international humanitarian law in Bosnia & Herzegovina by Serbian forces. As one of the more prominent forums of the Euro-Atlantic law enforcement and judicial community, you have an obligation to confront such crimes and those who deny them or promote hate. Any other response demands that we reconsider your mission objectives, as insensitive and selective.

Mr. Darko Trifunovic is also engaged in hate promotion directed against the Bosniak ethnic group as well as those who may be identified as Muslims by birth or faith. His Islamophobia is inciting hate and misinformation, but here with the particular dangerous motive of justifying old crimes/genocides and potentially promoting new ones by ultra nationalists in Bosnia & Herzegovina from within Serbian extremist ranks and others.

In the hope of promoting shared values, a common future and the rule of law, we ask that you further promote within national and multilateral jurisdictions such enforcement of current laws or adoption of new laws that would sanction denying the genocide and crimes judicially ruled with respect to Srebrenica and Bosnia & Herzegovina. Promoting hate by religion or ethnicity should already be incorporated in criminal codes, but also deserves greater vigilance in enforcement without exception.

We await your response with confidence in shared values and the rule of law.

A letter to Mr Darko Trifunovic
Subject: There WAS Decision on Genocide
From: Daniel Zeljkovic

Mr Trifunovic, recently you appeared on a Bosnian NTV Hayat Talk Show via satellite from Serbia. Vividly angry, disturbed, and constantly interrupting guest participant and TV Host, you have used your old line of arguments, quote:

If you say that someone killed 8,000 people in Srebrenica, I want to know who killed them? If 8,000 people died in Srebrenica… If 8,000 died, where are those people?….. In some cases court handed down decision that some people helped commit genocide, but there was no decision on genocide.

You were probably referring to the case of Vidoje Blagojevic whose complicity in genocide sentence was cut on appeal? You should be aware that even in his appeal judgment, the International Criminal Tribunal re-affirmed that Genocide in Srebrenica was committed, quote:

The Trial Chamber finds that the facts… the crimes of genocide, extermination, murder, persecutions through murder, cruel and inhumane treatment, terrorizing the civilian population and forcible transfer, and inhumane acts (forcible transfer) were committed in July 1995 following the fall of the Srebrenica enclave. (source: ICTY)

Furthermore, Srebrenica genocide has been re-affirmed by the International Criminal Tribunal in both – trial and appeal – judgments issued against Radislav Krstic, as well as by the International Court of Justice in a case of Bosnia vs Serbia.

You also pointed out that 3,200 Serbs died in Srebrenica, which is not true. Let me quote the International Criminal Tribunal, and I will even provide you a source:

For the whole region, i.e the municipalities of Srebrenica, Bratunac, Vlasenica and Skelani, the Serb authorities claimed previously that about 1400 people were killed due to attacks committed by the BH Army forces for the period of May 1992 to March 1995, when Srebrenica was under the control of Naser Oric. Now the figure has become 3,500 Serbs killed. This figure may have been inflated… these figures just does not reflect the reality. (source: ICTY)

Mr Trifunovic, it’s time for you to apologize publicly for your Srebrenica genocide denial and manipulations – not to us, but to the 8,000 + victims of Srebrenica genocide and their families.

MILENKO STJEPANOVIC: TRAVESTY OF JUSTICE

January 8, 2008 3 comments

Editor’s note: Less than three weeks after the Genocide Accountability Act of 2007 became law, Srebrenica genocide suspect Milenko Stjepanovic is to be deported from the United States to Serbia without any genocide charges. Is justice only ink on paper?

According to the Deseret Morning News, a sentencing date has been set for a Bosnian Serb resident alien who has admitted to failing to mention his involvement with a Serb military group that committed Srebrenica genocide.

Milenko Stjepanovic is scheduled to be sentenced January 15 to one count of visa fraud in Salt Lake City. Federal immigration laws forbid the entry of someone who is considered an “oppressor” in a conflict.

One question comes to our minds: Why haven’t prosecutors charged Milenko Stjepanovic on counts of genocide or complicity in Srebrenica genocide? Aren’t they aware that less than three weeks ago, President Bush signed the Genocide Accountability Act of 2007 into law following its unanimous approval by Congress?

Prior to enactment of this law, a non-U.S. national accused of committing genocide abroad could only be tried for a lesser crimes—such a visa fraud—or be deported to their country of citizenship, where prosecution might be unlikely or impossible.

We call upon the prosecutors to try Milenko Stjepanovic on Srebrenica genocide charge(s), as mandated by the Genocide Accountability Act of 2007. It is a travesty of justice to see prosecutors let Srebrenica genocide suspects roam free.

According to court records, Stjepanovic admitted that on his application for a green card that he served in the Yugoslavian People’s Army from 1969 to 1970 but failed to disclose that he also served with the Army of the Republika Srpska (VRS), which is a Bosnian Serb Army responsible for committing Srebrenica genocide.

A war-crimes inquiry found that members of the VRS participated in gross human-rights violations, genocide, and the massacre of over 8,000 Bosniak (Muslim) boys and men at Srebrenica in 1995.

The Srebrenica massacre has been classified as genocide by the International Tribunal for the former Yugoslavia, as well as by the International Court of Justice.

Stjepanovic is one of five Bosnian immigrants living in the Salt Lake City area who were indicted in June 2006 for visa fraud. All of them had applied for refugee status but failed to disclose their service with the Bosnian Serb Army (VRS).

During a hearing last August, Stjepanovic pleaded guilty in a plea deal reached with federal prosecutors. In exchange for his plea, prosecutors said they would recommend that he serve no prison time and instead be deported back to Serbia.

U.S. GENOCIDE ACCOUNTABILITY ACT FOR SREBRENICA GENOCIDE

January 2, 2008 6 comments

FINALLY, NO MORE SAFE HAVEN FOR SERB SUSPECTS OF SREBRENICA GENOCIDE HIDING IN THE UNITED STATES

[Full article after this short commentary…]
On March 31, 2006 we ran a story criticising the Bush administration for having no interest in prosecuting Srebrenica genocide suspects hiding in the U.S.
We also covered dozens of articles about Srebrenica genocide suspects being arrested and tried only on immigration violation charges. The Genocide Accountability Act closes a loophole that prevented the U.S. from prosecuting perpetrators of genocide in Srebrenica. We call upon the U.S. authorities to immediately re-arrest Serb Army suspects who were involved in Srebrenica Genocide and charged with (or acquitted of) immigration violation charges. They should be re-arrested and tried on Genocide related charges immediately (here is a list of some of the suspects). Special Thank You for Genocide Accountability Act goes to: Professor Diane Orentlicher, Congressmen Howard Berman, President George Bush who signed it and each and everyone of you who worked on this law being enacted.

NEW LAW ON GENOCIDE PROSECUTION WELCOMED BY OPEN SOCIETY INSTITUTE and SOROS FOUNDATIONS NETWORK

Press Release

Washington D.C. — The Open Society Institute hailed the coming into force of the Genocide Accountability Act of 2007. President Bush signed the bill into law following its unanimous approval by Congress.

The new legislation fills a critical gap in the law by permitting the U.S. government to prosecute people in the United States who are believed to have committed genocide abroad.

“By passing the Genocide Accountability Act of 2007, Congress has struck a major blow against the impunity that sustains perpetrators of ghastly crimes. From now on, those who have violated the basic code of humanity will know they cannot find sanctuary here,” said Diane Orentlicher, currently Special Counsel to the Open Society Institute and professor at American University’s Washington College of Law.

Prior to enactment of this law, a non-U.S. national accused of committing genocide abroad could only be tried for a lesser crimes—such a visa fraud—or be deported to their country of citizenship, where prosecution might be unlikely or impossible.

In Senate testimony in February 2007, Orentlicher in her capacity as a professor at American University’s Washington College of Law, urged Congress to consider “legislation that would enable U.S. courts to prosecute individuals suspected of genocide . . . when they are present in U.S. territory.” Following the hearing, Senators Durbin Coburn, Leahy and Cornyn introduced S.888, the Genocide Accountability Act of 2007, which the Senate approved by unanimous consent.

Congressmen Howard Berman introduced an identical bill to the House, and in October 23, 2007, Orentlicher, again in her capacity as a professor at American University, testified in support of the bill before the House Subcommittee and urged swift enactment of the legislation. She cited the example of Ratko Maslenjak, a member of an infamous Serb military unit connected to the 1995 massacre in Srebrenica—judged by two international courts to constitute genocide. But instead of facing trial for genocide, he was merely convicted of lying about his service in the Srebrenica unit when he applied for his green card.

The President signed the bill into law on December 21, 2007. OSI welcomes the law as a critical step forward toward meeting the American obligation to prevent and punish acts of genocide, and calls on the US government to vigorously enforce this statute.
